Throughout the site, the terms "we", "us" and "our" refer to BLENIN / Aluna Group s. r. o., with registered office at Budovateľská 672/15, 919 43 Cífer, Slovak Republic, Company ID (IČO): 57 532 907, registered in the Commercial Register of the District Court Trnava, Section Sro, Insert No. 62968/T.

By visiting our site and/or purchasing from us, you engage in our "Service" and agree to these Terms of Service, together with all policies referenced herein, including our Refund Policy, Right of Withdrawal, Complaints Policy, Shipping Policy and Privacy Policy.

Nothing in these Terms limits or excludes any mandatory rights you have as a consumer under the laws of the Slovak Republic and the European Union. Where any provision of these Terms conflicts with your mandatory statutory consumer rights, those statutory rights prevail, and the conflicting provision does not apply to you. These Terms are governed in particular by Act No. 108/2024 Coll. on Consumer Protection and Act No. 40/1964 Coll. (the Civil Code).

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

Section 1 — Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, or that you have given consent to allow any minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose, nor violate any laws in your jurisdiction. You must not transmit any worms, viruses, or code of a destructive nature.

Section 2 — General Conditions

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission. Credit card information is always encrypted during transfer over networks. We may refuse or cancel an order where there is a legitimate reason to do so — for example suspected fraud, an error in price or product information, unavailability of stock, or a breach of these Terms. We do not discriminate on the basis of a customer's nationality, place of residence or place of establishment contrary to applicable EU rules.

Section 3 — Accuracy, Completeness and Timeliness of Information

The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate or complete sources. We may modify the contents of this site at any time but have no obligation to update any information, except where required by law (for example, to keep product and price information accurate at the point of sale).

Section 4 — Prices and Modifications to the Service

Prices for our products may change over time and are displayed on each product page. The price that applies to your order is the price displayed at the moment you complete your purchase; once we confirm your order, that price is binding and will not change. We may modify or discontinue products or parts of the Service for future orders, which does not affect any order already confirmed.

Section 5 — Products or Services

Certain products may be available exclusively online and in limited quantities. We have made every effort to display product colours and images as accurately as possible but cannot guarantee that your screen's display will be accurate. Your statutory rights when purchasing these products — including the 14-day right of withdrawal and the statutory 2-year liability for defects — are described in our Right of Withdrawal and Complaints Policy. Any return or exchange terms we offer are in addition to these statutory rights and never replace or reduce them.

Section 6 — Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases. We may, for legitimate reasons (such as suspected fraud or a clear pricing error), decline or limit an order; if we cancel an order you have already paid for, we will refund you in full without undue delay.

Section 7 — Right of Withdrawal (14 Days)

If you are a consumer, you have the right to withdraw from a distance contract within 14 days without giving a reason, and we voluntarily extend this to a 30-day return period. You may notify us of your withdrawal by an unequivocal statement, including via the withdrawal form available in our online interface or by email to info@blenin.shop.

Section 8 — Liability for Defects (2-Year Statutory Guarantee)

All goods are covered by the statutory liability for defects for 2 years from receipt, as required by Slovak law. If goods are defective, you are entitled to repair, replacement, a reasonable price reduction or withdrawal from the contract, under the conditions set out in our Complaints Policy, which also explains how to file a complaint and our 30-day handling deadline. Nothing in these Terms excludes or limits this statutory guarantee.

Section 9 — Optional Tools and Third-Party Links

We may provide access to third-party tools and links over which we have no control. These are provided "as is" without warranty from us as to the third party's content, and any use is at your own risk. This does not affect our own statutory obligations to you as a consumer. Please review third-party policies before engaging with them.

Section 10 — User Comments, Feedback and Submissions

If you send us comments, reviews or other submissions, you grant us permission to use them in connection with our business. You are responsible for the accuracy of your own submissions and must not submit anything unlawful or that infringes the rights of others. We handle any personal data in accordance with our Privacy Policy.

Section 11 — Prohibited Uses

You are prohibited from using the site or its content for any unlawful purpose; to violate any laws or regulations; to infringe intellectual property rights; to harass or discriminate against others; to submit false or misleading information; to upload malicious code; to collect the personal information of others without authorisation; or to interfere with the security of the Service.

Section 12 — Disclaimer and Limitation of Liability

We do not guarantee that your use of the website will always be uninterrupted or error-free, and the website itself is provided on an "as is" and "as available" basis. This does not affect the products you purchase: all goods are provided with the statutory guarantee of conformity and the 2-year liability for defects described above. To the extent permitted by law, we limit our liability for the operation of the website; however, nothing in these Terms excludes or limits our liability where it cannot be excluded under Slovak law, including liability for death or personal injury caused by our negligence, for gross negligence or intentional fault, or for our statutory obligations towards consumers.

Section 13 — Severability

If any provision of these Terms is found unlawful, void or unenforceable, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall remain in full force.

Section 14 — Term

These Terms apply while you use our site and purchase from us. If you fail to comply with these Terms, we may restrict access to the Service for the future; this does not affect any statutory rights relating to orders already placed.

Section 15 — Governing Law and Dispute Resolution

These Terms and any separate agreements are governed by the law of the Slovak Republic. If you are a consumer, you also enjoy the protection of any mandatory provisions of the law of the country in which you reside, and you may bring proceedings before the courts competent under applicable EU rules.

Alternative Dispute Resolution (ADR). If you are a consumer and are not satisfied with the way we handled your complaint, you have the right to seek alternative dispute resolution. The competent ADR entity is the Slovak Trade Inspection Authority (Slovenská obchodná inšpekcia, SOI), Central Inspectorate – Department of International Relations and ADR, Bajkalská 21/A, P. O. Box 29, 827 99 Bratislava 27, Slovak Republic; email: ars@soi.sk or adr@soi.sk; web: www.soi.sk. You may also choose any other authorised ADR entity registered with the Ministry of Economy of the Slovak Republic.

Supervisory Authority. Supervision of consumer protection is carried out by the Slovak Trade Inspection Authority (Slovenská obchodná inšpekcia) – Inšpektorát SOI pre Trnavský kraj, Pekárska 23, 917 01 Trnava 1, Slovak Republic; web: www.soi.sk.

Section 16 — Changes to Terms of Service

We may update these Terms by posting the updated version on our website with a new "Last updated" date. Changes apply to orders placed after the update; they do not retroactively reduce your rights in respect of orders already placed.
